This document governs the regulatory compliance, privacy policies, and user licensing terms for PickedMyAI. Section A outlines our General Data Protection Regulation (GDPR) compliance statement. Section B outlines the End User License Agreement (EULA). Section C outlines our disclosures for United States (US) State Privacy Laws (CCPA/CPRA, VCDPA, CPA, CTDPA, UCPA).
SECTION A: GDPR DATA RIGHTS COMPLIANCE (EU & UK)
1. Scope & Applicability
This section applies specifically to individuals located in the European Union (EU), the European Economic Area (EEA), the United Kingdom (UK), and Switzerland, in accordance with the General Data Protection Regulation (GDPR) and UK GDPR. PickedMyAI acts as a Data Controller for personal data collected from Platform visitors, users, and service clients.
2. Lawful Bases for Processing
We process your personal information under the following lawful bases established in Art. 6 GDPR:
- Consent (Art. 6(1)(a)): When you voluntarily subscribe to our newsletter, sign up for a user account, or submit inquiries. You have the right to withdraw consent at any time.
- Performance of a Contract (Art. 6(1)(b)): When processing is necessary to deliver listing placement services, directory verification, or advertising services requested by you.
- Legitimate Interests (Art. 6(1)(f)): For improving search algorithms, web traffic metrics, security auditing, and fraud prevention.
- Legal Obligation (Art. 6(1)(c)): For maintaining transaction data for financial auditing and legal records.
3. Data Subject Rights
If you are covered by the GDPR, you possess the following rights:
- Right of Access (Art. 15): Request a copy of your personal data held by us.
- Right to Rectification (Art. 16): Request correction of inaccurate or incomplete details.
- Right to Erasure / Right to be Forgotten (Art. 17): Request deletion of your personal data when it is no longer needed.
- Right to Restriction of Processing (Art. 18): Restrict how your personal information is used.
- Right to Data Portability (Art. 20): Receive your personal data in a structured, machine-readable format.

4. Data Retention Periods
We retain collected personal data as follows:
- Subscribers & User Accounts: Retained as long as your account remains active or until you unsubscribe.
- Activity Data (Likes/Bookmarks): Kept while your user profile exists. Deletion occurs immediately upon account deletion.
- Inquiry & Form Submissions: Retained for a maximum of 3 years to track ongoing commercial partnerships.
5. International Data Transfers
PickedMyAI is operated globally. Data collected may be transferred to, stored, and processed in countries outside the European Economic Area (EEA), including the United States, where data protection standards may differ. When transferring data, we utilize Standard Contractual Clauses (SCCs) to ensure equivalent protection.
6. Cookie & Tracking Disclosure
Our site uses functional and analytical cookies to store your session data. We categorize cookies as follows:
- First-Party Functional Cookies: Session tokens, CSRF tokens, and dashboard preferences. Essential for core features.
- Third-Party Analytical Tools: Google Analytics (to measure traffic and tool click analytics). IP address anonymization is configured.
SECTION B: END USER LICENSE AGREEMENT (EULA)
1. License Scope
PickedMyAI grants you a personal, non-transferable, non-exclusive, revocable, and limited license to access our Platform, view curated directories, and use comparison tools strictly for personal, non-commercial research purposes.
2. Prohibited Uses
You are strictly prohibited from:
- Using automated scrapers, web spiders, data-mining scripts, or bots to harvest or replicate listing details and comparison data.
- Reselling, packaging, or licensing listings or directory contents.
- Impersonating AI tools, submitting fraudulent reviews, or distributing malware.
- Circumventing rate limits, CSRF protection, or security controls.
3. Intellectual Property
All curated content, directory formats, logos, code layouts, and proprietary rating indexes are the intellectual property of PickedMyAI. No rights are transferred under this license.
4. Limitation of Liability
PickedMyAI is provided "as is" and "as available". We do not guarantee the performance of listed AI tools. In no event shall PickedMyAI be liable for indirect, incidental, or consequential damages arising from the use of third-party software listed on this platform.
5. Governing Law
This EULA is governed by the laws of the State of California, United States. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts in San Francisco County, California.
SECTION C: US STATE PRIVACY LAW NOTICES
This section provides additional disclosures required under comprehensive state consumer privacy laws in the United States.
1. California (CCPA/CPRA)
Under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), California residents have the following rights:
- Right to Know: Request disclosures on personal information categories collected, sold, or shared.
- Right to Delete: Request deletion of collected personal information.
- Right to Correct: Request correction of inaccurate personal information.
- Right to Opt-Out: Opt-out of the "sale" or "sharing" of personal information. (PickedMyAI does not sell your personal data).
- Right to Limit: Limit use and disclosure of sensitive personal information.
- Right of Non-Discrimination: No discrimination for exercising CCPA rights.
2. Other Consumer Privacy States
Residents of the following states have similar consumer data protection rights under their respective state laws:

- Colorado: Colorado Privacy Act (CPA)
